What changed under Amendment C133hbay?

Hobsons Bay City Council's Amendment C133hbay took effect on 11 February 2026. It implements the Newport Structure Plan and the Inner Newport Heritage Gap Study through changes that include updated residential zoning, four Design and Development Overlay schedules, Heritage Overlay changes and other planning controls.

That is enough to make Newport worth treating as an individually researched suburb. It is not evidence that every Newport property has a Heritage Overlay or that every rooftop solar installation needs a planning permit.

THE PROPERTY, NOT THE POSTCODE, DECIDES

Planning controls are applied to individual land. Check the current planning map and the schedule that applies to the specific address before changing a solar layout for heritage or design reasons.

How to check a Newport property before designing solar

Use the Victorian Government's VicPlan map ↗ or obtain a current planning-property report for the address. Look for any Heritage Overlay and other controls that could be relevant to the proposed work.

If a Heritage Overlay applies, read the current schedule as well as the map. The schedule can determine whether particular solar-energy-system controls apply to that place or precinct. If another overlay applies, do not assume it is automatically a solar restriction; read the actual control and confirm the proposed works against it.

Hobsons Bay's C133hbay material includes changes to identified Newport heritage precincts and places. Those are targeted controls, not a suburb-wide heritage designation.

If a Heritage Overlay applies, panel visibility can matter

Hobsons Bay publishes solar-panel planning guidance for Heritage Overlay properties. Its guidance focuses on whether panels and supporting equipment are visible from a street, other than a lane, or a public park. The current planning scheme and the schedule for the individual property remain the controlling documents.

For an affected home, panel placement may therefore need to balance useful generation with heritage visibility. That does not mean hiding panels on a poor roof face before checking whether a permit is actually required.

A practical sequence is: confirm the overlay, check the applicable schedule, design the technically sensible array, then discuss any visibility issue with Hobsons Bay before the layout is locked in.

What do Newport's Design and Development Overlays mean for solar?

C133hbay introduced or updated four Design and Development Overlay schedules as part of Newport's broader planning framework. These controls are significant for development in the areas they cover, but a DDO should not be turned into a generic claim that rooftop solar is restricted across Newport.

For an ordinary existing house, first establish whether the property is actually covered and whether the proposed solar work engages the relevant schedule. If the project is part of a larger renovation or redevelopment, coordinate the solar design with the planning work rather than treating it as an afterthought.

Electricity distributor and connection approval

Jemena's published network-planning material includes the Newport zone substation and places Newport within its north-west Melbourne network planning. Before relying on any export or connection setting, confirm the distributor for the exact address using the Victorian Government's distributor lookup or the electricity bill.

Network area alone does not determine what an individual home will be approved to export. The final connection application needs to match the property's phase configuration, existing inverter equipment, proposed solar or battery inverter capacity and the distributor's current approval.

Already have solar in Newport?

If the home already has rooftop solar, collect the inverter model, system age and measured imports and exports before deciding whether to add panels, replace equipment or install a battery.

A battery does not automatically require a new solar inverter. A healthy existing system can often remain in service with an AC-coupled battery, while other properties are better suited to a hybrid-inverter replacement or wider redesign.

Before accepting a Newport solar quote

  • Confirm the planning controls for the individual address rather than relying on a suburb-level statement.
  • If a Heritage Overlay applies, check the current schedule and the visibility of the proposed equipment.
  • Ask whether the proposed layout has been changed for a real planning reason or merely an assumption.
  • Confirm the actual electricity distributor and connection approval for the final inverter design.
  • Have any export limit stated clearly in the proposal.
  • If a battery is included, separate ordinary battery operation from blackout-backup capability.
  • Check current Victorian and federal incentives immediately before committing.
